Thailand approves new regulations for the deportation of foreign nationals The Thai government has issued a clarification regarding the "new rules for the deportation of foreign offenders", which officially came into force on August 28, 2026. The document comes into force on August 28, 2026. Purpose of the new regulation The regulation establishes a clear and effective procedure for the deportation of foreign citizens who have violated the law or committed actions that pose a threat to public order and morality.

The measures taken are aimed at ensuring the safety of both Thai citizens and numerous foreign citizens who legally reside, work and travel in the country. The new procedure applies to foreign nationals who are involved in the following main categories of offences and crimes: ▫️Illegal entry into Thailand or violation of the permitted period of stay under immigration law; ▫️Employment without proper authorization; ▫️Conducting business activities in violation of foreign business laws; ▫️Forgery of official documents or use of forged official documents; ▫️Committing crimes for which the law provides for punishment in the form of imprisonment for a term of five years or more; ▫️Participation in the commission of these offenses and crimes as a direct perpetrator, instigator or accomplice.

The new regulation also improves the interaction between the Department of Correctional Services and the Ministry of Home Affairs. In particular, after a foreign national has served a sentence imposed by the court, deportation proceedings can be initiated immediately, without undue delay.

The adoption of the new procedure is not aimed at restricting the legal travel, employment or investment of foreign nationals. Its purpose is to make a clearer distinction between foreigners who are legally present in the country and make a positive contribution to Thai society, and those who violate the law.
